Daniel Stoddard has nearly two decades of experience in building intellectual property portfolios and structuring complex transactions for a wide range of clients including start-up, midsize, and fortune 500 companies.
Practice
Dan’s clients have looked to him for advice regarding a diverse array of technologies including biotechnology - therapeutics and diagnostics, medical devices, green technology, mechanical devices, and processes including electronics manufacturing.
He assists clients in global patent procurement, freedom to operate and intellectual property due diligence analyses, as well as trademark registration and trade secret policy development.
Dan also counsels clients on transactions including life-science technology licenses, corporate partnership, co-development, and commercial agreements including selling, buying, supply, clinical studies and other contracts.
Background
Dan was previously Head of Legal Affairs both at a public biotechnology company and a prominent top-funded Silicon Valley cancer therapeutic start-up that since underwent an IPO. He served as Head of IP and Assistant General Counsel at a public-facing cancer diagnostic company and Associate General Counsel on the commercial team at a leading global medical device company.
While working in-house, Dan helped manage a team of lawyers responsible for obtaining ultra-high-worth patent rights providing the company a preeminent IP position in the space and publicly attributed as the main contributing factor to a company valuation in the many-billions. He has developed IP portfolios supporting products sold globally including throughout the United States, the United Kingdom, Europe, China, Israel, Brazil, Canada, and Australia. He continues to work internally as Chief Legal Advisor of an early-stage biotechnology company.
While serving as Head of Legal Affairs, Dan managed a complex patent litigation before the U.S. Court of Appeals for the Federal Circuit. He engineered and executed a strategy of obtaining a particular allowance providing significant leverage against the opponent. The ensuing settlement partnership agreement led to a rise in the company’s stock price of over 500%. Dan has also orchestrated over 20 offensive and defensive European patent opposition procedures, giving him the perspective needed to obtain enforceable proprietary patent rights on behalf of his clients globally. Prior to working in companies, Dan was an attorney at leading Silicon Valley law firms Fenwick & West LLP and Bozicevic, Field & Francis LLP.
Throughout his career, Dan has taken an proactive role in developing the careers of new legal practitioners. He was responsible for training new Associate lawyers at Fenwick. He has also lectured on topics including intellectual property, transactions, and career development at a variety of colleges and law schools. Dan served for many years on the American Diabetes Association Leaders Forum Advisory Committee and is a former president of the San Francisco Intellectual Property Law Association.
